Another Delay: U.S. Court of Appeals Suspends Implementation of NLRB Notice Posting Requirement

The U.S. Court of Appeals for the District of Columbia (the Court) suspended the implementation of the National Labor Relations Board (NLRB) rule that would require nearly all non-profit and private-sector employers to display a National Labor Relations Act (NLRA) employee rights poster by April 30, pending further review.

The Court will hear the case on appeal from the district court which ruled that the NLRB has the authority to require employers to post a notice, but that they exceeded their authority in two ways-by deeming failure to post an unfair labor practice and tolling (waives the ability to claim) the statute of limitations for claims brought by employees against employers that failed to post the notice.

CCS Alert - NLRB Notice Posting Requirement Takes Effect April 30

A mandatory federal change from the National Labor Relations Board (NLRB) has occurred that affects many U.S. businesses. Covered employers must post a NLRB notice of rights by April 30, 2012.

U.S. employers under the purview of the NLRB must display the new poster. Businesses excepted from this requirement include agricultural, railroad or airline employers, small employers, and retailers all of whom may not be required to post. Consult with your accountant or business advisor if you think your business could be exempt.

As we detailed in our September 28, 2011 CCS Alert, the notice, available with translations on the National Labor Relations Board website www.NLRB.gov, states that employees have the right:  

  • To act together to improve wages and working conditions
  • To form, join and assist a union
  • To bargain collectively with their employer
  • To choose not to participate in any of the preceding activities

The notice also provides examples of unlawful employer and union conduct and instructs employees how to contact the NLRB with questions or complaints.
